National Company Health (NCH) – Terms of Use and Conditions:
1. Introduction These Terms and Conditions (“Terms”) govern membership in National Company Health (“NCH Network”) and the use of NCH services, programs, administrative functions, and affiliated networks.
By enrolling as a member, participating organization, employer, association, or payor (“Member” or “Members”), you agree to be bound by these Terms. NCH reserves the right to update or modify these Terms at any time. Continued use of NCH Network services constitutes acceptance of any revised Terms.
2. Important Legal Notice 2.1 NCH Is Not Insurance NCH is not an insurance company, does not provide insurance coverage, and does not assume financial risk for medical services.
2.2 NCH Is Not a Discount Medical Plan NCH is not a discount medical plan organization and does not sell or offer discount medical plans/cards.
2.3 Nature of NCH Services NCH provides administrative, membership, and network access services only. All medical decisions, services, treatments, and financial obligations remain solely between Members and their chosen healthcare providers.
3. Scope of NCH Services NCH provides administrative and membership based services to: Individual Members Self insured funds Associations Self insured employers Payors Member groups utilizing NCH-Network memberships, benefits, or networks NCH may provide the following administrative functions:
3.1 Invoice Administration-Consulting, NCH may review invoices on behalf of Members, self insured entities, employers, associations, payors, and groups that utilize NCH services. This includes: Reviewing member invoices submitted by providers Routing correct priced invoices to the appropriate Member or payor Facilitating communication-consulting between Members and providers Providing administrative support for Member funded or employer funded health arrangements NCH does not guarantee payment of any invoice and does not assume liability for medical costs.
3.2 Access to Medical Networks Members may receive access to NCH medical and other networks, provider groups, or negotiated service arrangements. Access does not guarantee coverage, payment, or approval of services.
3.3 Member Services & Benefits NCH may offer non insurance membership benefits such as: Administrative-Consulting support Provider navigation Network access Customer service assistance These Member non-insured benefits do not replace insurance and do not constitute financial protection against medical expenses.
4. Member Responsibilities Members agree to: Pay monthly-membership-network fees, and any applicable charges Pay all medical bills, invoices, or provider charges and/or payment arrangement, Provide accurate and updated information to NCH Use NCH services in compliance with these Terms and applicable laws Members remain fully responsible for all healthcare decisions and costs.
5. Provider Relationships NCH is not a healthcare provider and does not practice medicine. Providers are independent professionals who contract separately with Members and Networks. NCH does not control or guarantee: Provider availability Quality of care or Medical outcomes, Members must resolve all medical disputes directly with the provider.
6. No Guarantee of Outcomes NCH does not guarantee: Approval of services Payment of final priced invoices Access to specific providers Any particular health outcome. Membership is strictly for member services-administrative and NCH network access purposes.
7. Payment Terms Membership fees are due monthly as stated in Membership Enrollment agreements or invoices. Failure to pay may result in suspension or termination of membership. NCH is not responsible for any medical bills or financial obligations incurred by Members.
8. Limitation of Liability To the fullest extent permitted by law: NCH is not liable for medical decisions, treatments, or outcomes NCH is not liable for provider actions, omissions, or billing practices NCH is not liable for any financial loss related to medical expenses, NCH’s total liability is limited to the amount paid by the Member for membership fees in the preceding 12 months
9. Termination NCH may terminate membership for: Non payment Misuse of services Fraud or misrepresentation Violation of these Terms Members may terminate membership according to their membership agreement.
10. Governing Law These Terms are governed by the laws of the state in which NCH is headquartered, without regard to conflict of law principles.
11. Acceptance of Terms By enrolling in NCH or using NCH services, the Member acknowledges and agrees to these Terms and Conditions.
